1. Service Provider

2. Description of Service

Picstome is a Software as a Service (SaaS) platform that allows users to store, organize, and manage content online. Access is provided via the internet, and no software installation is required beyond a compatible browser.


3. Account Registration

  • You must be at least 18 years old to create an account.
  • You must provide accurate and complete information during registration.
  • You are responsible for keeping your login credentials secure.
  • You are responsible for all activities under your account.

4. Service Availability & Disclaimers

  • We strive to keep Picstome available at all times, but we do not guarantee uptime or uninterrupted access.
  • Picstome is not responsible for data loss, corruption, or delays caused by technical failures, maintenance, cyberattacks, or any event outside our control. We are not a Backup service!
  • Scheduled maintenance may require temporary downtime; we will provide reasonable notice where possible.
  • Important Privacy Notice: Picstome uses caching and content delivery technologies to improve performance. While we do our best to protect your files, we cannot guarantee complete privacy, as users or third parties may capture, copy, or share content once it has been displayed. Please do not upload sensitive or confidential materials.

5. Subscription, Renewal & Cancellation

  • Subscriptions are billed automatically at the start of each billing cycle (monthly or annually).
  • Unless cancelled before the renewal date, subscriptions renew automatically.
  • If your subscription is not renewed, all your data will be permanently deleted within 7 days.
  • By law, EU consumers may have a right to a refund within 14 days of purchase if they have not yet started using the service. Once service use begins, this right may be waived as permitted by law.

6. Pricing & Changes to Service

  • We may change our pricing or features at any time, but will give at least 30 days’ notice before changes take effect.
  • We reserve the right to discontinue or modify any feature without liability.

7. Acceptable Use Policy

You agree not to:

  • Use the service for illegal purposes or in violation of applicable laws.
  • Upload, share, or store content that is unlawful, defamatory, obscene, abusive, or infringes intellectual property rights.
  • Attempt to hack, reverse-engineer, or disrupt the service.
  • Misuse APIs or integrations, including sending excessive or abusive requests.
  • Share your account with others unless explicitly permitted.

We reserve the right to suspend or terminate accounts violating these rules without refund.


8. Intellectual Property

  • All software, designs, and branding of Picstome remain our exclusive property.
  • Your content remains yours, but you grant us a limited license to store, process, and display it for the purpose of providing the service.

9. Beta Features

We may release experimental or beta features. These are provided “as is”, may contain bugs, and can be withdrawn without notice.


10. Security

  • We take reasonable measures to protect your data.
  • You are responsible for securing your own devices, browsers, and passwords.
  • We are not responsible for breaches caused by your negligence.

11. Indemnification

You agree to indemnify and hold Picstome harmless against any claims, damages, liabilities, costs, or expenses arising from:

  • Your violation of these Terms.
  • Your content or actions that cause harm to others.
  • Your misuse of the service.

12. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential damages, including loss of data, profits, or business opportunities.
  • Our total liability is limited to the amount you paid for the service in the 12 months prior to the claim.

13. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, power outages, internet failures, or government actions.


14. Termination by Us

We may suspend or terminate your account immediately, without notice, if:

  • You breach these Terms.
  • Your payment fails and is not resolved within 7 days.
  • We are required to do so by law.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Spain and the European Union. Any disputes will be submitted to the courts of Barcelona, Spain.


16. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated by email or via the website. Continued use of the service after changes indicates acceptance.
